Pregnant Woman Dies In Truck Accident

San Francisco news reports that a pregnant woman has died at a construction site in Martinez, California. According to CBS News, the woman was parked near a city construction project. As a truck full of gravel was preparing to dump its load, the truck toppled over and landed on the car, crushing the vehicle and killing the woman inside.

A construction worker had been trying to assist the woman back out of her driveway to make room for the truck, but the accident occurred before she was able to move. Compounding the tragedy, the woman's 4-year-old daughter had been watching and witnessed the entire incident.

Cal/OSHA continues to investigate what caused the truck to fall on top of the vehicle.

Several factors may be implicated whenever an accident occurs. For example, it will be important to determine whether this tragedy was simply the result of drive error, or whether the truck was properly maintained in good working order, and/or if a defective part caused or contributed to the accident. Where negligence creates an unreasonably dangerous situation, and harm occurs, the victim and his or her family may be able to recover damages for medical expenses, lost wages and pain and suffering.

The driver of the truck was a subcontractor on the job, working for JJR Construction.
